I don't think he's thought that out either, though...
SR is a loose sequel to Supes II, for which Luthor WAS in jail for the crimes he committed againts the Californian coast. He got out, and ended up at the Daily Planet, then taken to the Fortress Of Solitude.
Depending on whichever version you see, we don't really know how Luthor got back from there, but one must assume that Supes turned him over to the authorities.
I think in SR it is explained that the wealthy old lady petitioned for his release or something stupid like that, which is just as stupid but at least gave a reason. Quite why Supes on returning to Earth didn't just lock Luthor up again is a mystery.
The film defies any explanation and was as poorly thought out as it was made.

I still really wish they'd consider Kevin Smith as director for the next one....if there is a next one.

Yeah, the old woman, I thought about that too, but wasn't sure if she got him out of prison or just gave him all her money when she died....(eww....that part was so unbelievably crass, and what the heck was with those two creepy dogs licking each other during that scene and then one apparently having eaten the other later in the film....?! )
But what I think that guy was getting at was that just because the courts don't have Superman around to testify doesn't mean they wouldn't lock up Lex Luthor after all the s*** he's pulled over the years....wouldn't they have a ton of his other victims, like, say, anyone living in the state of California, to testify against Lex?
It makes no sense but conforms to the film's depressing underlying subtext about how nothing Supes did really mattered.... At least that was my interpretation....
Also, one more thing: (and maybe this was answered in a deleted scene)
Why does Lex Luthor say to Supes before stabbing him with the Kryptonite: "You took away five years of my life....I'm just trying to return the favor!" Huh? Supes was gone for five years, Lex was ostentibly in jail for some of those years, then freed when Supes didn't show up for the trial....? Never mind, you're right Ben, this film makes no sense at all and has such a visible contempt for its audience it boggles the mind....

More Kevin Smith on Superman Returns!!

I personally think he takes it easy on Bryan A LOT, I'm sure he's got lots more opinions but not even KS is completely fearless:
It's one thing to diss aborted films that have never been made by people who are no longer even (for the most part) associated with those films, it's quite another to diss a filmmaker still very much in Hollywood, still making that current series...
Not even KS is that brave...

I don't know when Smallville's latest season aired in the US, but it's just starting here tonight after a long wait.
Now THIS is Superman. For all the twists and turns they've introduced and playing with the mythology the guys making this series should have really been behind the Superman movie.
They get the characters, they know the movies: tonight opener with Zod's taking over Earth is great (typing this in commercials!) with several nice lines of dialogue taken from Supes II, and a very nice throwback to the "28 known galaxies".
It's such a shame that they couldn't run this series into a new bunch of movies...Welling is a much more charismatic Kal-El than Routh, everything is tied together and directed much better than the Returns fiasco, and the only frustrating thing is how close they obviously want to get to using the Williams score but have been curbed off that by the movies. Season three or four actually used the Superman theme, but they withdrew it on subsequent seasons, which is a real shame.
And the kid whi just turned up as Jimmy Olsen might be the best guy to fills those shoes on screen ever. He seems very familliar...trying to place him...but he's perfect. Nice intro scene between him and "CK"!

Anyhoo, he's a great Jimmy. Perhaps too young for the Singer films, but then again, Marc McClure was pretty young when he was in The Movie, and since the rest of the cast is so young too it might'a worked. Better than gay-Jimmy they ended up with. No one at the Daily Planet was cast right in that film, especially Perry "Hippie" White.
